Lake Village Manor HOA: Enforcement Procedures

The Covenant Enforcement Process: The Covenant Enforcement process involves a 4 stage procedure to encourage compliance with the Association Covenants.

Stage I -- 1st Violation Notice

The first stage is a simple notice of the violation that was observed, stating what must be done to bring the violation into compliance, and finally provides a deadline for coming into compliance or discussing the matter with the Covenant Enforcement Officer.

Stage II -- 2nd Violation Notice

This stage entails a second violation notice which provides a second 10 day period to comply. The consequences of non-compliance are detailed, including the fact that legal action will be taken to ensure enforcement.

Stage III - Referral to Board of Directors

At this stage, the Covenant Enforcement Officer refers the violations to the Board of Directors, with his recommendation for Board action. The Board may choose among several options, including: 1)referring the matter to the Attorney for legal action; 2) sending a letter to the owner requesting compliance; 3) deferring action until a future time.

Stage IV -- Civil Suit

At this stage the violation is referred to Association Council for enforcement through the Civil Court system. At this stage, all costs which are incurred by the Association are assessed to the Owner of the Property. Costs for pursuing into court often exceed $1000.00. The covenants, recorded on the land records and incorporated in all deeds for properties in Huntington Neighborhood, provides for the passing on of these legal fees.
